Terms of Service

3.1 Account Creation

To access certain features, you must create an account using Discord OAuth2. You agree to:

• Provide accurate and complete information
• Maintain the security of your account
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

3.2 Account Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the Service or other users
• Extended inactivity
• Any other reason at our sole discretion

You may delete your account at any time through your account settings. Upon termination, your right to use the Service will immediately cease.

4.1 Submission Requirements

When submitting a bot, you represent and warrant that:

• You own the bot or have permission to list it
• Your bot complies with Discord's Terms of Service and Developer Policy
• Your bot complies with our Submission Guidelines
• All information provided is accurate and not misleading
• Your bot does not contain malicious code or violate any laws

4.2 Review Process

All bot submissions are subject to review and approval. We reserve the right to:

• Reject any submission for any reason
• Request modifications before approval
• Remove approved bots that violate our policies
• Change our review criteria at any time

4.3 Content License

By submitting a bot listing, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to:

• Display your bot information, description, and visual assets on our platform
• Use your bot name, logo, and screenshots in platform features and promotional materials
• Resize, optimize, or reformat images for display purposes
• Display and share publicly available statistics about your bot
• Include your bot in search results, recommendations, and category listings

You retain all ownership rights to your bot, code, and content. The license granted above is limited to operating the Service and terminates when you remove your bot from our platform, except for cached or archived copies that may persist for a reasonable period.

You agree not to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Submit false, misleading, or deceptive information
• Engage in spam, phishing, or other fraudulent activities
• Attempt to gain unauthorized access to our systems
• Use automated tools to scrape or collect data without permission
• Interfere with or disrupt the Service
• Upload malware, viruses, or harmful code
• Harass, abuse, or harm other users
• Manipulate ratings, reviews, or statistics
• Create multiple accounts to circumvent restrictions
• Use the Service for any illegal or unauthorized purpose

The Service and its original content, features, and functionality are owned by Conscherry and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

The "Discord Labs" name, logo, and all related marks are trademarks of Conscherry. Our trademarks and trade dress may not be used without our prior written permission. All other trademarks, service marks, and logos used on the Service are the property of their respective owners.

You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

Our Service may contain links to third-party websites, services, or bots that are not owned or controlled by Discord Labs. We have no control over, and assume no responsibility for:

• The content, privacy policies, or practices of any third-party services
• The functionality or safety of listed bots
• Interactions between users and bot developers
• Any damages or losses caused by third-party services

You acknowledge and agree that Discord Labs shall not be liable for any damage or loss caused by your use of any third-party services. We strongly advise you to read the terms and conditions and privacy policies of any third-party services you use.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free operation
• Security of data transmission

We do not warrant that the Service will meet your requirements or that any defects will be corrected. Your use of the Service is at your sole risk.

To the maximum extent permitted by law, Conscherry, Discord Labs, and their respective affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

This includes, but is not limited to, damages for:

• Loss of profits, revenue, or data
• Loss of use or goodwill
• Business interruption
• Cost of substitute services
• Any other intangible losses

This limitation applies regardless of the legal theory (contract, tort, negligence, or otherwise) and whether or not we were advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

You agree to indemnify, defend, and hold harmless Conscherry, Discord Labs, and their respective affiliates, officers, employees, agents, partners, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your bot's content, functionality, or operation
• Any dispute between you and another user

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you consent to our collection and use of your data as described in the Privacy Policy.

We respect intellectual property rights and expect our users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, please contact us with:

• A description of the copyrighted work
• The location of the infringing material on our Service
• Your contact information
• A statement of good faith belief that the use is not authorized
• A statement that the information is accurate and you are authorized to act
• Your physical or electronic signature

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will:

• Provide at least 30 days' notice before the new terms take effect
• Update the "Last Updated" date at the top of this page
• Notify registered users via email or platform notification

Your continued use of the Service after any changes indicates your acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service.

14.1 Governing Law

These Terms shall be governed by and construed in accordance with applicable international laws and the laws of the jurisdiction where the Service operates, without regard to conflict of law provisions.

14.2 Dispute Resolution

We encourage users to contact us first to resolve any disputes informally. For any disputes that cannot be resolved informally:

• You agree to first contact us at contact@conscherry.com to attempt resolution
• If informal resolution fails within 30 days, either party may pursue legal action
• You agree that any legal action must be brought within one (1) year of the dispute arising

14.3 Limitation on Claims

You agree that any claim or cause of action arising out of or related to use of the Service must be filed within one year after such claim arose, or be forever barred.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by Discord Labs.

These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and Discord Labs concerning the Service.
